My question involves emancipation laws for the State of: Florida

I am old enough to be emancipated and my father is willing to sign the petition. My mother is not aware of what we are planning yet. My father and mother are divorced and they have joint custody. Can my father petition for my emancipation without her consent? Also my mother is on prescription pills and abuses them and has even overdosed a number of times, even once on our dog's seizure medication. Also, I know it's off topic, but do I have to have a job to be emancipated? Thank you for your time.

You not only have to have a job, or at least an income, to be emancipated, you cannot be emancipated unless you are capable of completely supporting yourself, alone and unassisted. That means you can pay rent, food, clothes, utilities, medical care, transportation, insurance, school fees and supplies, and all the other incidentals of life, all by yourself with no help from anyone. All this while going to school and getting good grades. If you can't do this, don't waste the court's time applying as you will automatically be turned down.

And yes, if your mother has joint custody, she must also agree and sign the petition, assuming that you meet the requirement above.

I suspect that your mother is the custodial parent, and your father is so gung ho about this because if you are emancipated, he no longer has to pay child support.
