    Default Liability After Mechanic Sold my Car

    Hello,

    A guy performed some motorwork on my 1998 Z-28 Camaro. He kept my car for more than 18 months. I continued to bring him money in excess of $4,000 and then found that he was scamming me and not fixing my car at all. I then told him that I wanted my car back whether it was fixed or not. My car wasn't paid for, I was still paying the car note + insurance the entire time he had my car. He told me he wanted more money. I tried to involve the police but they said it was a civil matter. At this point, I am in financial trouble. I pay a lawyer a small fee and she sends him a letter asking him to surrender my car. He sent me a letter telling me he was going to auction my car off if I didn't bring him an additional 1800.00. I declined his offer and he sold my car in another state. During this time, I filed bankruptcy, let the company know that he was with holding my car, and have since purchased another vehicle. He and his wife and me and my mother have since been served with civil papers from the finance company. They want someone to return their car. Is this guy going to be locked up for selling my car and taking advantage of me or what? I need to know what to expect.

    You benefit from having had the lawyer send the letter before the bankruptcy, as it helps you document that the person had taken control of your car. It is also worth exploring if he followed the law and proper procedure in relation to his sale of the car. You should consult your bankruptcy lawyer about the extent (if any) to which the present action is barred or limited by the bankruptcy judgment.
