If your employer counted it as income (which your employer should NOT have done under an accountable plan, and it wasn't in your employer's best interest to do so either..sigh) then you can deduct it as an employee business expense.

You should bring this to the attention of your employer.

As far as the business expense goes your probably going to be shorting yourself. Most places don't pay the .58 per mile government rate they rather pay between 30-40 cents (not counting truckers). There fore you can always claim that as a business expense but your going to be paying tax on the amount as income and therefore not really making as much as you should be.

The employer can do it any way they want to. If they provde, say, a $500 a month allowance for personal car usage and don't require the employee to support any amount of mileage, they can certainly do that. And if they do that they are required to report the $500 as income on the W-2 and the employee claims their mileage expense on form 2106. Most employers require an expense report to claim the mileage and then reimburse according the the standard mileage rate, in which case they would not report it as income and the employee does not deduct it on their return. But the choice is the employer's.

The question says nothing about a vehicle allowance it clearly states she is paid for her MILES.

Like I said you should bring this to the attention of your employer and see why this is being counted as income.
