    Default Divorce from an Illegal Resident

    My question involves divorce in the State of: California

    I'm French and have my green card for years, my wife is also French but she doesn't have a green card, we have been married for 10 years, 4 years ago, she decided to leave me to live in Israel without my consent, she goes in vacation with my son (10 years old at that time) and didn't come back, after one year of 'negotiations' I finally convicted her to come back in Los Angeles with my son, of course, she did everything to ends our relationship, one year ago, she started having an affair with a Native American (he's married with 4 kids), now she took an apartment to live her life but she's doesn't work and she's spending everything I give her, I'm giving her almost $7000.00 a month and its never enough, I'm paying because my son, but at the same time, I didn't pay my taxes for years cause all the money I make goes to her, today, I cannot pay anymore and want to divorce, so what can I do??

    File for divorce, obviously. There's nothing stopping you from doing so.

    Get a good, mean, tenacious attorney. Petition for sole custody of your son.

    When the divorce is final, get a good tax attorney and start setting those to rights. The IRS doesn't look too kindly on folks who fail to pay their taxes.

    Hello,

    thanks for your reply,

    I have emails I intercepted between my wife and her affair and also other guys she met, love emails, etc..., she gave me her old laptop to be repaired thinking she had deleted her emails but she didn't and of course, I bought a new one (stupid I am...), so I have her laptop, is this a valid proof??, can I use the emails contents for my divorce???,

    please let me know and thanks agin for your help,

    You don't need proof of anything to file for divorce unless you intend to allege fault.

    It appears you do. Take the laptop to the attorney with you.
