    Default Early Termination of Probation

    My question involves criminal law for the state of: California/Texas

    I have 2 misdemeanors from almost two years ago in California and I now live in Texas. The end result was three years of summary probation. I am trying to get into the military but the recruiter I am dealing with says that I cannot enlist while on probation. Is there any way I can get off of my probation early?

    You can speak with the probation department where you are and show them what you are trying to do. However I dont think that would be much help. Thats strange the recruiter told you that, because the military can grant entry even with probation. Maybe talk to them a little bit more in depth or have your recruiter call probation or attest to what your trying to do. I'd call another recruiter just to make sure things cant be done anyway, I know for a fact they could do this when I enlisted.

    Because I live in El Paso TX, I had to contact my probation department for San Diego, where I was placed on Summary Probation.

    The person I spoke with said that all i need to do is file a motion for early termination. She also said that because I have met all the requirements of my probation and I am trying to get this cleared up for the military, I should not have any problems.

    The last part is because I now live in TX, I would have to file my motion by mail. All sounds good, except she did not have any info on exactly how to file a motion by mail ie: where to send it and what to send.

    Any ideas!?!

    If they have a website check and see if the forms are on there. Most courts are putting SOME forms online now or you could ask the clerk to mail you one.

    Generally speaking you must appear to argue your motion. You file your motion in accord with the court rules. I suggest that you consult a lawyer about filing the motion, and whether the lawyer believes it could be argued (by the lawyer) in your absence.

    I truly doubt that there's going to be a "form" motion for early termination of probation on the court's website. That's wishful thinking.

    I found a PC1203.4 form. Any ideas if this is what I am looking for?
    The form says it is for expungement, but there is a section that might cover early termination but I am not 100% on it.
