What you have now is a temporary order (not the perminant order I was referring to above) - and they are VERY easy to get - for good reason. They are granted when there is allegation of violence - and in the big picture, courts generally grant the temporary ones very easily, because they are well aware that if it isn't needed, that should be reasonably argued at the hearing. In other words, people call the fire department when they smell smoke, they don't wait to make sure that the 20 foot flames are real. Temp orders work the same way - you issue a temp one now to put SOME level of protection in place, until such time as both sides can be there before the court to tell their side and allow the court to determine if the flames are real or bogus.
