    Question Burglary About Drugs

    My question involves criminal law for the state of: Illinois, of dupage county. I was wondering if I could recieve some help on this. So I know of something that has happend with burglary and drugs. Two people went to an apartemnt to steal drugs. One person breaks in while the other follows. Now one person only takes drugs and was the one who didn't literally break into the apartment. The apartment was a drug dealers place. I was wondering if this case my be thrown out or what would be the sentence for the person who just stole drugs? Also before the case went to trial, if this person started to go to rehab would that help lower his years in jail?

    Theres multiple charges and without knowing all the facts its hard to tell. Heres some questions to help narrow the CHARGES down.
    Was there anyone home at the time of the burglary?
    Any weapons used during the crime?

    Both persons would be guilty of the same crime. They both entered with the intention to deprive someone of their property in this case drugs. Which makes them both guilty. Ill go with the lower charge and assume no one was home (this would be home invasion), assuming there was no weapon used to threaten or discharged (numerous other charges), it looks like just as you have it residential burglary. Heres something you can read..

    Under Illinois Law (720 ILCS 5/19-1), a person commits a burglary if they: 1) enter or without authority remains within a building, house trailer, watercraft, aircraft, motor vehicle as defined in the Illinois Vehicle Code, railroad car, or any part thereof, with 2) intent to commit therein a felony or theft.

    Under Illinois law, Burglary is considered a Class 2 crime which is punishable from 3 to 7 years in jail.

    No weapons were involved and no one was home. All though this person is friends with his drug dealer (obviously no anymore) and has been over there before with permission to be there. Just happens that this time they were stupid and thought they could get away with the crime. Also this person told the cops the truth when questioned and the cops had no clue that the person being robbed for there drugs was a drug dealer. Thank you for the reading I will look more into the Illinois law.

    Regaurdless if they had permission or not they committed a theft while inside the property. Which equals a burglary, I suppose if your friend would roll and help the police out they might help your friend out.

    Are you saying that the people who did the breaking in bit had permission to enter? Or are you saying only that they had previously been given permission enter the residence, but that the permission wasn't open-ended towards future entrances into the residence?

    Okay ... so ... is the victim willing to testify that they lost an amount of an unlawful controlled substance with a street value of X dollars? If so, the victim would be confessing to a crime. It's possible they could BOTH go down for crimes.

    This is an example of the saying, "When you play with the dogs, you might get fleas." The victim might be better off cutting his losses - and his ties - and changing his locks before he just lets the matter go.

    Why would your friend steal from a drug dealer? They obviously don't follow the law, and probably won't handle this lawfully either.
