My question involves a child custody case from the State of: Virginia
I have a close friend who has been married for 4 years in the state of VA. Two months ago, his wife moved out of the family home. They have a 2 year old child together. Neither party has filed any paperwork as of yet. They have been equally splitting time with their son. No money has exchanged hands...they both provide for their son while he is in their care. My friend works from home, has a very flexible schedule with no need for any child care. She has a job outside the home. She informed him that in order to make ends meet, she will be getting a male roomate. In a brief consult with a lawyer, my friend was told that he can object to his wife having a male roomate with regard to their son and mom's time with their son. Is this true? Would this be grounds for my friend to try to get primary custody? When they were together, his wife didn't work, but they were both home all day and he was more the primary caregiver than she was. Will this make a difference if he wants to go for primary custody? He was originally going to try mediation because they both agreed that they would share physical custody 50/50, with no child support, but since this issue with the roommate has came up, he's not so sure he wants his son to be living with a total stranger 50% of the time. Any advice as to what his next move should be?
