    Default Could/Would My Friend Be Prosecuted in House Search if He Had NOTHING to Do with It

    Ok a buddy of mine lives with his friend and his friend's gf. He doesn't do any drugs at all, just drinks but hes over 21, so he can. He pays rent to his friends girl cause its her house, actually I believe its in his friends gf's parents name, the house. Well, the breakdown is, they believe their house phone is being tapped, which is probable being my buddy's friend is selling drugs. Well if the cops happen to come and bust down the door and search and bust my buddys friend, would my buddy be in trouble and go down for the same charge even though he is ALWAYS in his room, doesn't do any drugs, and minds his own business, or would the cops just prosecute the person selling the drugs???? Hes very very very worried cause the phone tap recently started, they hear lots of clicking all of a sudden on it and i even used the phone and yeah, def sounds like its being tapped. But see he doesn't provoke anything drug related, he isn't about drugs which is why he doesn't smoke. He has nothing in his room illegal.

    I figure he could go down as well but i figure cops can control who gets prosecuted and who doesn't. If he could go down just cause of the simple fact he lives in the house as well, do you really think the cops would prosecute him being hes a clean cut guy, doesn't do drugs?

    First, the clicking noises from phone taps stopped being reality in the 80s ... maybe even before that. if they ARE "tapping" the phone, there won't be any weird noises. I suspect he's paranoid from his drug use.

    Second, yes, you can possibly get in trouble if the house gets raided. if drugs are found ina common area or your name came up as someone who was present or assisted in the drug sales, you could be toast. If some guy even came to the door and said he was there to buy some dope from your roomie and you went to get him, then you may well be a principal to the sales. A lot depends on what info they have and the laws in your un-named state. But, at the very least, you will likely be detained and investigated, if not arrested.

    Your buddy needs to find a new place to live or he will very possibly end up sharing a jail cell with his roomie.
