    Exclamation Vita-Blender V. Vita-Mix

    Hey All,

    Here is the scenario: We filled up an application for a trademark 'vita-blender' last year. Today we got a letter from USPTO. It says that a notice of opposition to the registration has been filed from a company named vita-mix. We've been asked to answer in forty days. What should we do to defend ourself? What are the procedures regarding this? Please advise. Thanks in advance.

    Avail yourself of the services of a Trademark attorney in your area.

    You'll be expected to explain your rationale behind your name, provide examples of your usage prior to filing, and be able to completely differentiate yourself from the company that has filed an objection.

    It's far smoother with an attorney.
