    Default New York State Paternity Law

    I live in New York State. I'm 18 and just had my son born Dec 19 2005 . The mother of my son mom claimed him on her taxes this year. They made a new law that the child has to be 6 mounths or older to claim on taxes. Now my name isnt on the birth certificate how would I get it on there ASAP and what can I do about her mom claiming my son

    Huh??? I've never heard of any such law that says you can't use a child as a deduction unless they are 6 months old. I think you are confusing it with the fact that in order to be able to claim the must have lived with you for 6 months of the years you are filing for.

    Are you the LEGAL father, meaning you have taken a dna test to prove you are the father or that you signed an affidavt of paternity.

    Are there any court orders in place concerning the child?

    Who does the child live with?
