My question involves labor and employment law for the state of: CO
Here is my main question, but this has been a big ordeal, so I would appreciate any other thoughts/comments about my legal rights. All the details are at the bottom.
Company agreed that I must relocate to a main office by a negotiated date 3 months from when I was given verbal notice. Manager first said I would not get relocation, then the next day said I would receive relocation based on clarification from HR that people that lived 50 miles away from the main office qualified. My husband was able to transfer jobs, so he gave up his position where we live. My relocation was approved by the necessary management and I started the official relocation process with my relo counselor. We used the Company-provided realtor to find a home and we close in 21 days. We have scheduled our move with the company's movers. We are using the company suggested mortgage company because the company is to pay for our closing costs.
Now, 5 weeks later, they said they are not going to pay relocation and the fact that they would was all a misunderstanding. They said I could have an additional week to decide if I really wanted to relocate or not.
The company paid me partial relocation (because the move was self-initiated) when I moved away from the office.
Can they really not pay for our relocation when we are so far in the process? I do not believe it was a misunderstanding because everyone I know received the same relocation offer. And even if it was, we made life changing decisions based on the full-package, which included them relocating us.
Thank you
Company XYZ says they are eliminating positions working from home and employee can relocate to the main office. The details:
1) Employees told they have 1 week to decide if they are going to relocate
2) Told I would not receive relocation, then received notice from manager that I lived more than 50 miles from the office, so they would pay relo
3) if employees did not relocate, they would be considered as resigned on X date (34 days after notice)
4) told they would not qualify for severance or 60 days notice, per work from home agreement that says company can end work from home at any time
5) company promised this was not a layoff, but later acknowledged that this was a good way to eliminate employees and has since had a mass layoff
