    Default Stop Sign Height Regulations in Georgia

    My question involves a traffic ticket from the state of: Georgia

    I recently got a ticket in a town i was unfamiliar with running a stop sign that had to be 3' off the ground. Partly obscured by cars parked on the right hand side of the road. Is anyone aware of a standard height regulation for city stop signs?

    I think you can win this one. I believe in rural areas, the bottom of the sign must be at least 5 feet from the pavement. In areas frequented by parked cars or pedestrians, I think the bottom of the sign must be at least 7 feet from the pavement. By the way, those standards are regulated by the MUTCD.

    This certainly may not be right but I think it is. If you do some searches, you should be able to find out for sure. Let us know how you come out!

    thanks for the quick reply! i have been trying to find regulations online, but no luck. Hate to pay a lawyer for this. How can i find the legal code or statute that regulates this?

    Chucky, you are absolutely correct. Here is the MUTCD section. Unfortunately, it's NOT a "standard", meaning these are just examples. However, unless there is some good reason NOT to comply, I'd argue that a sign to place according to these "guidelines" is, indeed, improperly placed. Georgia law provides:
    Quote Quoting OCGA § 40-6-20
    § 40-6-20. Obedience to traffic-control devices required; presumptions; enforcement by traffic-control signal monitoring devices
    ...
    (b) No provisions of this chapter which require official traffic-control devices shall be enforced against an alleged violator if at the time and place of the alleged violation an official device was not in proper position and sufficiently legible to be seen by an ordinarily observant person. Whenever a particular Code section does not state that official traffic-control devices are required, such Code section shall be effective even though no devices are erected or in place.
    Take pictures, take them to court with you.

    thanks guys.
    Unfortunately after going back it all depends on what kind of car is parked in those spaces. But still is really hard to see. I was hoping there was a HEIGHT requirement.

    My 'bad'. I guess I should have known that because the MUTCD also says that stop signs shouldn't be used to control speed..when, in fact, that's precisely the reason so many towns have so many inappropriate stop signs. (Our little village seems to get a new one every month, or so.)

    Get somebody with one of those great big herky 4X4 trucks to park there and then take a few pictures.
