In our divorce papers from 2003, I am to get my son as a dependent each year with my ex signing 8332 (she has had physical custody of the two kids). My daughter came to live with me for this ('08) school year (and hopefully physical custody will be permanently changed).
Since '03, my ex has taken both kids and refused to sign the form. After last years court cases, I believe (in Dec/Jan when I asked for it) she was told by her Attorney she "had better" give me the form so she did. She signed it with my daughters name (I assumed just because she is the one living with me now and it doesn't matter to me which one of the two).
My taxes were just rejected as the SS # for my daughter was already used. I spoke with my ex and she states she could care less what she signed she is claiming both kids. I have been told I have to take the tax papers and original form 8332 to the metro IRS headquarters and "file in person"?
Will this cause any "red flags" on my return or only on hers? Is there any other recourse? What will happen if I take this in? Will she be audited (or me/my wife) or will they simply re-do her return? Will it take a lot longer to get my refund back versus if I had been able to easily E-File? I have tried to deal with her but I wish there would be some negative consequence for her unfair and deliberate action here. Thank you for any thoughts on this topic!
