    Default Caught Driving With Restricted License In New York

    Okay, so basically my husband was being stupid. He realizes this, but now we need to know what, if anything can be done.

    My husband, Matt, has a restricted license due to some back child support issues.(Custodial parent made agreement with Matt outside of court which Matt followed, but then custodial parent change her mind when the child was three and took hubby to court, so he ended up owing back support for three years, which was several thousand dollars. So Matt ends up with judgments on his credit and a restricted license.) Matt decided to go fishing one night about a week ago and drove himself with his restricted license. (dumb, we know) He gets pulled over, less than one minute away from home for supposedly running a stop sign that he didn't run. The trooper gave him a ticket for driving with his restricted license when he wasn't supposed to be.

    So, what kind of penalty is Matt looking at and can anything be done to perhaps lessen the penalties? I guess I should also mention that knows the judge in this area, so the judge would be willing to help, but his hands, I'm guessing, are pretty much tied.

    Perhaps Matt can pay off his arrearage, get his license reinstated, and make it easier for the judge to give him a break.

    What exact section of the Vehicle and Traffic Code is he charged with violating? VTL 511.1? If so it's a criminal misdemeanor,

    Aggravated unlicensed operation of a motor vehicle in the third degree is a misdemeanor. When a person is convicted of this offense, the sentence of the court must be: (i) a fine of not less than two hundred dollars nor more than five hundred dollars; or (ii) a term of imprisonment of not more than thirty days; or (iii) both such fine and imprisonment.

    The ticket says that he was "in violation of NYS V and T Law, Section Sub Section 5306." Then there is a box that has two choices. The first choice is Tr Inf and the other is Misd. Tr Inf is what is checked. Don't know what that means. And as far as just paying off the arrears goes, well we don't happen to have $7,000 right now. Thank you for the help though. Believe me if we could pay it off then we would.

    The citation appears to be for this charge.
    Quote Quoting New York VTL 530.6
    It shall be a traffic infraction for the holder of a restricted use license or privilege to operate a motor vehicle upon a public highway for any use other than those authorized pursuant to subdivision three of this section.
