Situation is that a married 22 yo woman is currently pregnant. She and her husband have decided that they cannot care for the child and are trying to decide whether to terminate or adopt out. She would like to know if she can designate the family she wants the baby to go thru before she gives birth(which I believe she can) and would like to know if she can do a private adoption thru an attorney without having to go thru court (both she and her husband are making the decision together). Does she need to go thru an agency? Do all prospective parents need to be approved by an agency? (ie homestudy and such)
Her family is pushing her to terminate instead of adopt, and will not support her keeping the child. There are 3 families willing to adopt the child, and all are willing to have an open adoption.
If they do not wish to go through a licensed adoption agency, they really need to hire an attorney. Adoption should never be done without an agency or an attorney.

Yes, any prospective adoptive parents would need to be approved by the agency if one is used.

If it is a situation where they personally know the prospective adoptive parents, they should get a consult with a local adoption attorney before proceeding.
