    Default Automatic payment to creditor taken before agreed upon date

    My husband and I agreed to a repayment plan over a span of six months with Ventus. In December, they withdrew the proper amount before the agreed upon date and the money wasn't in our bank account. I have been partially reimbursed for fees charged to my account as a result of this early withdrawal and subsequent NSF items but have been unsuccessful in collecting the rest. Is there a better way to collect from the collectors? How long should I wait before I consider any potential legal action? Is legal action worth the nearly $300 they owe us? We are low income and that makes a big difference to us!

    Default Collection of Funds

    If they don't correct the problems they caused within a reasonable amount of time, consider taking them to small claims court for any money they still owe.

    Consider adding overdraft protection to your account, to minimize problems in the event that anything like this happens in the future. Most banks seem to charge only if there is an overdraft.

    Default o/d protection

    We did have O/D protection in the form of a savings account attached to the checking account that would be drawn from in the event of an O/D. This was depleted with the first O/D and from there on out it was $32 to $35 each. Our credit wasn't good enough to qualify us for a line of credit style O/D protection account.
