This is a question for Illinois.

Recently I was laid off and provided a Severance package. During the initial discussion with my boss I was in a state of shock. He told me that HR would be sending me an agreement. After a Day I still had not received the copy of the Agreement so i contacted HR. The HR person explained the Severance agreement. I questioned the # of Weeks pay as I originally thought it was One week for every 2 years worked. HR said it was One week for every year worked. HR however said they would be sending the final agreement to my Boss for approval. Later that day HR called me and informed me that My Boss approved the agreement.

I signed my copy of the agreement and returned it. One week later I received payment per the terms of the agreement.

This is where it gets sticky. 3 weeks after this has all been said and done I received a call from my (former) Boss. He told me that my Severance was overpaid. I was a bit shocked. He claims that he told me it was One week for every 2 years and not the One week for every year. I explained to him that I questioned HR and that I was told this was correct and he approved it.

2 weeks later I received a Certified Letter explaining that I should have contacted the Boss personally to question this, that HR didnt have the authorization to give me the agreement i Signed and the company paid.

They are asking me to repay 1/2 of my severance. From what I understand of contract law, they wrote it up, I signed it and they acted upon it. Do they have a case to now undo and get me to pay them back??
