    Default Landlord Does Not Return Security Deposit Even After Court's Judgement

    My question involves a security deposit in the State of: New York

    My landlord deducted a large chunk of my security deposit. I sued my landloard in the small claims courts. The court gave judgement in my favour and ordered the landlord to pay me back 80% of my security deposit. Even after that the landlord does not pay back my security deposit. The case was settled by arbitration. The landlord's attorney says that it is better for me not to pursue the execution of the judgement and if I still pursue the landlord will sue me in the local court and ask for higher damages and I will have to pay the landlords attorneys fees as well. Can the landlord sue me in the local court of the different county after the case has been settled in the small claims court by arbitration? Is the landlords attorney playing mind games with me regarding this? Please advice. I am a newbie here.

    You need to go to the court clerk and order an "abstract judgment" Then record the judgment in the county clerks office.

    Anyone can sue anyone. It is just a ploy. Yes a mind game.

    You record your judgment so you can collect your money.
