    Default Breaking Sublease

    My question involves landlord-tenant law in the State of: New York (NYC)

    I signed a sublease last Sept 1 with one of my housemates. He is the one on the actual lease with the management company, and I pay him. The apartment is occupied by him, another guy and me (much younger girl) and I've reached the point where I'm really not happy or comfortable with the living situation. Frankly, I try not to spend any time there, because they're always cooking loads of meat which makes the place smell or watching TV loudly when I'm trying to study in my room (TV is right next to my door).

    I am considering telling my roommate that I am looking to move out (a months notice) and am trying also to find someone to take my place. What are the possible legal repercussions that could come of this? He has a 1000$ deposit which I am almost positive he will try and keep. Is there any way to prevent this from happening?

    Any advice would be greatly appreciated.

    that would depend on what your lease states concerning moving out before the lease expires.

    Under failure to uphold responsibilities:

    Primary tenant aknowleges that the primary tenant shall remain responsible for existing rental agreement in the event that subleaser fail to uphold responsiblities hereunder. Subleaser aknoleges that PT may recover the actual damages sustained by the PT and reasonable attorney's fees if the subletter fails to uphold their responsibilities herein.

    The thing is, if he were to come after me, I have no money (parents pay rent, but I'm on the sublease)...

    he could most likely gt a judgment against you. They last around 10 years in many states and are often renewable so if you plan on having any money in the next 20 years or so, he may be able to grab it.
