    Default Same Race Discrimination

    We have a 30 year old black female employee claiming that her 37 year old black female manager is discriminating against her. She claims that her manager gives another white female employee better bonus opportunities and lets her do personal things on the companies time. Our manager manages about 20 employees. Both black and white, which none as backed her claim. This employee told us she is going to the EEOC and that she will take this to the end. She said you will have a huge investigation and will see us in court. I truly believe we will win. But, can she really cause us such hardship in an investigation? Plus she still works for us. I don't want retaliation claim also...

    An EEOC charge is not as complicated as you might think. You really need to hire a local employment attorney when and if you get the charge.

    This employee requested in writing all of her complaints and communications with us. I did a 5 page summary of all that happened and how we responded to it. Do I have to worry about this request? I did my investigation and no one felt or saw any discriminatory actions. If she is claiming race discrimination from her manager, wouldn't she have to have some other black workers be in agreement also? Can a manager discriminate against her own race?

    They wouldn't have to be black for a claim to stick. Any workers at all siding with the person claiming discrimination will do.

    Sure she can.

    But it sounds to me like the manager is simply rewarding the person who performs better, and lets appeals to race fall by the wayside.

    That doesn't make sense to me. How can this manager discriminate against one black employee but not another in the same job? Either you're a racist or you're not. Is it her responsiblity to prove I'm guilty or my responsiblity to prove I'm innocense with the EEOC?

    You've never heard of misogynist women?

    It's not unusual for people to have an intense dislike/hatred of their own kind.

    But you're missing the point.

    She can discriminate against her own race.

    But I don't think she is. I think she's judging the employees on their merits, and the black employee is pissed about it.

    If you're not going to sit down and take a breath, and choose instead to panic over threats, it's really in your best interests to speak to an attorney now, and let him/her reassure you.
