    Default Employer's Demand for Apology

    Dear Aaron,

    I am from Malaysia. Yesterday I received a notice from a legal party which representing my ex-employer. They are demand for apology on my action of sending an email to their client as below:-

    {I am here to share with you my experience which hard feel been
    cheated by a Japanese MNC. I am giving 1 month notice of my resignation from 2 Dec 05 - 1st Jan 06. Due to I am still have balance of 12 days annual leave, I have requested to use up this 12 days annual leave as my balance notice. I believe this is the standard practice and everywhere practice the same.

    So, P company has agreed and issued a acknowledgement letter to me. (see attachment)

    I thought everything is clear and I left the company on 13 Dec. Unfortunately, P company did not pay me the full month salary with offset 12 working days of Annual Leave. They only paid until 13 Dec which is my last day service with the company. I was shock and call-up the HR Officer, initially the HR officer said they miss-calculated and will pay it back by Jan 06. Unfortunately, this is not the end.....the next day, the HR officer call me and said "Oh! Actually we cannot pay you the 12 days annual leave, because you were given not enough notice to the company........this is the instruction from my manager"
    Ha..............? Why suddenly this kind of thing happened??
    I asked : "Why HR never told me all this grandmother story before I left?
    P company: "You never ask."

    Can you imaging that this happened in a Giant Japanese MNC??
    Without any written notice, not even verbally informed, they refuse to pay me 12 working days of annual leave. }end

    Could you tell me what should I do? Should I apologise?

    This is a Japanese company operating in Malaysia? If so, that's way outside my areas of expertise.

    Yes. It is in Malaysia. Could you give some advice? Although I am not mentioned the company name directly they still can sue me for damage libel?
