    Default Settlement from Semi Truck Accident

    My question involves an injury that occurred in the state of: Washington State.

    I was rear ended on I-5 by a speeding semi truck. I was also in a semi truck but I was doing the speed limit and the one that hit me was doing about 85mph according to witnesses. I had injury's to my neck, back, knees and right shoulder. The accident happened in Nov of 2005. I have had multiple operations on my knees and am still under going physical therapy for my back and knees.

    The other trucks insurance company gave me $65,000.00 for pain and suffering only. We made sure that lost wage compensation was not included in the initial settlement. I have been on L&I since the accident. I have been losing about $1500.00 dollars per month from what I was taking home, to what I get now in documented wages.

    My question is this. Since I have lost approx $18000.00 per year for the last 3 1/2 years. Can I sue the trucking company/insurance for what I have been losing. At the time of the settlement, I did not realize how long it would take to put me back together. There was no lawyer involved. Let that be a lesson learned. Am I facing a civil statue of limitations?

    The settlement papers do state, For pain and suffering only, everywhere my signature appears on their copies as well as mine. Thank you to who ever takes the time to answer.

    1. Can I renegotiate for lost wages?
    2.Am I facing a civil statue of limitations?

    Can you sue or make a claim against the trucking company again, despite the prior settlement? One of the documents you signed when you settled would have been a release of all claims.

    I made sure that I did not sign a release of ALL claims document. Also the meeting between them and myself was recorded with their permission. In it, it is stated that this partial settlement was for pain and suffering only and not for medical costs and lost wages. That is made clear by the their representative. But am I going to now be up against a statue of limitations because it has been 3 1/2 years?
