    Default Take Fathers Right Away

    My question involves a child custody case from the State of:South Carolina
    My question is Can i take my daughters father's right away?
    My daughter is 9 months and her father has nothing to do with her. He is not on the birth certificate. He has seen her 3 times and that is all. He has not provided her with anything. He will ask about her every now and then but that is it. I know he will not sign his rights away but he is not acknowledged as her father and we have not been to court. I just don't want him to try to take her or anything. My situation is not bad but I don't want it to turn bad.

    He has no rights to have taken away. Legally he is not the father. If at any point he chooses to be file for rights with the court and he is found to be the father, he will very likely have rights that you will not be able to have taken away.

    Until he files though, he has no rights to her at all. Don't plan on filing for child support or any type of state aid without having him declared as the father.
