My question involves criminal law for the state of: Florida, specifically Collier County Florida!!
Violation of probation.. 12 days before my probation was to end, at check in probation contends that they did not get a large enough urine sample to test. The told me to use a regular cup, not a normal test cup and go in a different bathroom. I signed all of the papers to early terminate, paid all fines due. I left, they attempted to contact me to come back. I didn' go back, thinking it was a trick. They posted a warrant and picked me up 1 week later.
Doesn't probation have a protocol they must follow? in order to make this violation stick. Obviously, after 1 year there were no issues with the urine test any other time. I always used a test kit there, and always tested negative.
Can't we argue that they didn't follow procedure, and therefore I did not violate. It was a misunderstanding.
I'd appreciate any helpful info out there
