    Default B&E

    My question involves criminal law for the state of: michigan, im being charged for b&e. me and my girlfriend lived together. yet my name is not on the lease for the apartment. we broke up, and that day i was grabbing my things out of the place, s
    he was not there, and she got upset and called the law! i had my own key in my pocket, yet i was almost done getting my things out so nothing of mine was really in there. i had mail coming there and check subs for the rent. but i sat in jail two days waiting for a bond to be set and being charged for b&E!!! how do i get out of this?

    You work with your attorney, present information to show that you had not actually moved out and still had a lawful right to come and go, and hope the state buys it.

    The problem you might have will be if you had actually vacated the property and had not been there for some time. if you told people you no longer lived there and had, in fact, taken up residence elsewhere, you might consider making a plea deal.

    In the end, consult an attorney and listen to his advice on the subject.
