    Default Bench Warrant - No Bond

    My question involves criminal law for the state of: South Carolina

    My friend was arrested on Sunday, 3-29-09, cause he had a bench warrant issued by probate court in 2005. He was told that Sunday that he will go to court on Monday, but he didn't. I was given false information until this morning. He seems to be not bail eligible. Probate court hasn't scheduled a court day yet. How long can he be kept arrested? His mom is old and sick and needs to be looked after and my friend is her only child. What can I do to help him?

    Until he's arraigned, all you can do is help look after his mom and save up for an attorney. Is the court that issued the warrant in the same jurisdiction that is currently holding him (same county)?

    You may be able to hire an attorney to possibly review the case and then give a bond. but the most likely scenario is the arraignment. I think however he should have gone to some kind of first appearance.
