    Default Furlough Law

    My question involves employment and labor law for the state of: New Jersey

    Our company just announced that everyone will be forced to take a 1 week Furlough. The way they are doing this is by giving a 4 day pay day instead of five for 1 week for each of the next 5 months. However, they made a point that during those weeks, you still must work 5 days.

    I myself am NOT complainining as I am still employed, but several people in the company are complaining and thinks this may actually be illegal to make us work the full 5 days during those weeks.

    Any ideas?

    salaried or hourly

    exempt or non-exempt

    If non-exempt, they could do this if they simply reduced your pay rate so your new 5 days of work equals your old 4 days worth of work income. If they state a pay rate and simply do not pay you for some of your hours worked, it is illegal.
