    Default Life Estate Trust in New York

    NEW YORK STATE - My childhood home is in a life estate trust in my parent's names; my mom is dead and my dad is still alive. My husband is also on the life estate with me. When my dad dies, does his share go to me so I will own 2/3 and my husband will own 1/3? Or do my husband & I own the house 50/50? My dad has in his will that I am his sole heir. I am trying to figure out if I ever get divorced if my husband is entitled to 1/2 the house proceeds or 1/3. Thanks.

    I can't see the deed from here. You need to post the granting language, or run the deed past a lawyer.
