    Default Child Support After Legal Father Goes to Prison

    My question involves child support in the State of: massachusetts

    Hello,this question is more about legality then morality. 10 yrs ago I was involved with a female and she got pregnant. When she was 4 months pregnant she met another man and they began dating. When the child was born her boyfriend was at the hospital with her. He signed the birth certificate and a few months later they got married. They were married for about 7 or 8 yrs. in this time I had not heard or seen my child at all. In this time they had 2 more children and lived in there own house. A few yrs ago the husband went to jail for bank robbery and is gettin out at the end of this summer. Now she is fileing for CS from me and also fileing for divorce from her husband. So where does this leave me,does she have a case against me to collect CS? It jus seems to me that now she is down on her luck,she is trying to extort money from me.

    It appears that right now her husband is the legal father. She will have to disestablish paternity for him and then file to have your paternity established.

    For now, get a consult with a local attorney. Just in case she does file, you should begin to set money aside for any retro support that might be ordered.

    Either way, do NOT agree to anything until you have proof that paternity has been disestablished, and you need to request a DNA test if she files.

    Here is the mass law of diseastablishing paternity. I believe this is up to date. If it isnt clue me in.

    Allows disestablishment of paternity at any time and requires cancellation of child support and arrearages. Excepts cases of adoption, artificial insemination and where the man knew the child was not his before being presumed or acknowledging himself as the child's father.

    Well unless the person listed as the father proves he is not. Then you would have to be proven as the father. Then at that time you could have to make child support payments. But you should not be responsible for child support payments from years prior. Because you were not proven to be the father.

    Also if you are proven to be the father and making child support payments. You could take her to court to get visitation with your child.

    Although being 10 years has gone by and it seems you have not been apart of this childs life. It will be hard to obtain the visitation.
