    Default Custodial Grandparents vs Paternity Rights

    My question involves grandparents rights in the State of: OHIO. We the maternal grandparents have legal custody of grandson 18 months of age. Children services were involved per our lawyers request of neglect/ abandonment charges His mother granted us legal temp. custody in courtroom on his first birthday. We since then received permanent custody and Mother having no rights except to pay child support as she did not show up to court or have a lawyer there for her. NOW comes the paternity testing, does the father have automatic custodial jurisdiction over child now that he is proven father?

    No, he'll have to sue for visitation and/or custody.

    And you can pursue child support from him.

    OK, now I have another question.

    We do not want to raise our grandchild for the rest of his life as we do love him dearly but have already raised 4 children into adult hood. The Father of this child should take responsibility and deal with the raising of this child. Can we ask courts to relinquish our custody to him automatically?

    You can ask, but the court may say no if it does not appear to be in the best interests of the child.

    You'll want to discuss the possibility more fully with your attorney, of course.

    Well we do only want is best for the baby of course, that is why we got custody of him in the first place. Absent father is absent because he was underage and his parents refused to let him do a thing until the Mother proved paternity which she never did. 1 week after Father became of age he sought paternity testing mutually with us because he wanted to know!
    We are by no means trying to pawn off the child just because he is Father but truly are hoping he will show up to be responsible parent to his son.

    Totally understand where you're coming from.

    My own grandparents hoped that my parents would step up and do the right thing, too. They never did, so the court kept me with my grandparents. The court was wise.
