Our oldest child has turned 21, other child is 19. I am still paying child support as determined in divorce. Both are college students and mom is paying (enrolled them both), without my help/assistance. I have the understanding that I can not "file to emancipate" the two of them at the same time, but our oldest has turned 21 and I am thinking of eliminating him for child support. What is the process? I think you can file the "emancipation" forms and at that time it is all done and said, BUT, can mommy fight this anyway at all? Can she modify the child support amount in any way? Can she increase it???.......OR does the amount always go down? I understand that the amount is not porportional (ie. amount equals 1/2), but what (if any) conditions would change the amount for more than what I am paying now?
My income has not changed. Her income may have increased slightly, but she has re-married someone who makes exactly what I make (as a matter of fact, it is a co-worker of mine!!!).
