    Default Post-Nuptial Agreement

    Does anyone have experience with post nuptual agreements? Unfortunately there was not a prenuptual agreement and now one side of the marriage is looking for asset protection.

    Laws vary, quite dramatically, by state. You need to keep in mind here, as well, that we're talking about two potentially different states - the state where the post-nup is executed, and the state where a divorce subsequently occurs. Generally speaking you would want to have complete financial disclosure, independent legal representation for both spouses, and an outcome that's fair both at the time it is signed and at the time of any future divorce.
