The Age to Decide

At what age , in Nevada, are childre able to tell the court they what to live with another parent? Any one know. my children want to come and live with me but their father is completely unreasonable. We live in the same city. Only 10 miles away? Should I submit request for an interview with them? they are 11 and 12 already.

In any state, the age at which a child is able to make a binding decision as to which parent they want to live with is 18. The judge may or may not take their wishes into consideration but they don't get to choose as long as they are still minors.

If you want them to come live with you, you will need to apply to the court for a change of custody.

ok, yes, that is what I thought. I spoke, before with a lawyer who told me that same thing. However, I was hoping that there would be some way to have an interview made with them as to atttach it to the modification.

I am just afraid that the judge will say that it has been so long since they have lived here with me that they will not change the order. So I want to have as solid of proof and cause as I can when I go in, I won't know unless I try. thank you.
