    Default Seller wants to back out of contract

    My uncle sign a contract with a seller. In the contract both parties agreed he had the right to let a person of his choice take over the contract if he wished. He has done so, and she does not want to sell the house. He then called her and said he himself was going to buy the house and she is still backing out. The contract is signed and it at a title company.

    Contact a local real estate attorney. He can demand the sale or collect damages depending on the validity of the contract, the sales price, and the fair market value. A call from an attorney may change her mind.

    Default "Specific Performance"

    As real estate is considered to be unique, a lawyer may also be able to assist you in getting a court order compelling a sale.

    You can, of course, attempt that without a lawyer; but I personally would get legal help for any such litigation.
