    Default F1 and Diversity Visa

    Hello Folks,
    This is my first post here. I have got a few questions on both the F1 visa and the diversity visa ( I know the latter is not relevant to this subforum but I didn't want to multi-post on the same topic.)
    I currently hold nationality of a country that is NOT eligible for the diversity visa. I was born and brought up in a country that IS eligible for the diversity visa lottery (although I have never held nationality of that country). I plan to go to the states this year to pursue grad studies under an F1 visa. So here are my questions:

    1. I did some reading on the internet and I believe I do qualify to apply for the diversity visa. Could some one re-confirm whether a person by virtue of being born in a country that is eligible for the diversity visa also can apply for it?

    2. I can't apply for the diversity visa this year, I plan to apply for 2011 after going to the United States. I am not worried about whether I get in or not but will my application for the green card lottery potentially affect me later if I want to reapply for an F1 (changing schools) or apply for a H-1B (as in will I be evaluated as a "potential immigrant" and get rejected in those visa) ?

    Are you stating that you were born and raised in a country that is eligible for the DV lottery, but you're not a citizen of that country and don't presently reside in that country?

    Hi,
    Thanks for replying.Yes. That is exactly what I am saying. I did check up the clauses in the diversity visa rules. It seems to me that I do qualify as a "native" to apply for the diversity visa?

    As the State Department indicates, Your country of eligibility will normally be the same as your country of birth - for example, although Canada is an ineligible country, a Canadian citizen born in Morocco would have qualified for the diversity visa in 2008 even though he was not a citizen of Morocco.

    I suppose it's possible that trying for the lottery could raise a question as to whether you intend to immigrate to the United States when you later apply for nonimmigrant visas; but I don't think it's likely to be a problem.
