    Default Removal of Fingerprints from Live Scan

    I was wondering in a case of mistaken identity would filing a MC235 order for destruction of fingerprints and arrest card remove your prints from live scan. I also would like to know would the FBI still have them after the MC235 was granted? I reside in Michigan.

    I would argue that MCL 28.243(8)'s provision that "the fingerprints and arrest card shall be destroyed by the official holding those items" would include any state agency holding electronic copies of your fingerprints. If you want to know for sure, ask the Michigan State Police.

    The state court order isn't binding on federal agencies, so it's possible that the FBI would keep copies even if the state records were completely destroyed.

    Thank you for your response. I have received my arrest card and fingerprint cards back from the local police department. Just was wondering if it was any way to be me made whole again as if this whole thing never even took place. You have answered my question. I really appreciate the response.
