    Default Young Girl, Older Guy

    I know some people, and they are not a couple, but they had sex when he was 18 and she was 15. Now she has a kid at 16, and she thinks he is the father. But she and her parent are not wanting to get a DNA test done, because they are afraid of getting him in trouble. But the boy also wants to know for sure if its his or not. He is not some thuggish kid either, he plans on helping out with everything, but he just wants to lay low until the legal stuff passes. What should they do?

    He can pay for private paternity testing and find out if he's the father or not.
    They basically give a "yes/no" answer with a percentage of probability and the test results only go to him.

    Unfortunately, having sex with a minor under the age of 16 in Oklahoma has already PUT him in trouble - the legal stuff doesn't "pass" and often comes up to bite when least expected. Her parents also need to be aware that legally, they cannot give this boy permission to commit a crime against their child, and that if anyone, a neighbor, friend, teacher, or homeless guy under a bridge should REPORT the crime, not only are criminal charges against the adult father of the child probable, but criminal charges against the parents of the mom COULD be pursued too (doesn't happen that often, but certainly isn't rare, either).

    At some future date, even YEARS from now, if mom ever applies for government benefits or benes for the child, they'll pursue paternity on behalf of the child. Also, he needs to be aware that without paternity being established, he is a legal STRANGER to the child - meaning that at some future point if the merry couple becomes....less merry...that he has NO legal right to visitation with the child, AND mom has no claim to child support - unless and until paternity is established and the court establishes the parental rights/responsibilities of the parties.

    So you think that they should get the paternity test done even though he is going to get in trouble? How much trouble would he be in because he wont do them any good in jail.

    Having a PRIVATE paternity test done impacts nothing - it only informs HIM if he's the father or not. It's the "official" testing as part of an application for government aid, paternity, visitation, or child support that will bring the statutory rape issue to a head.
