    Default Caught on Camera Shoplifting

    My question involves criminal law for the state of: Texas

    My fiance and I were caught on camera shoplifting at 7@RGE7 and they didnt stop us at the store entrance, the alarm didnt go off, and no one followed us in the store but instead an employee in red and a security guard followed us in the parking lot to the edge of the parking lot and then the 7@RGE7 employee followed us in his own personal vehicle all the way to get gas and then followed us to the street and held up the trash of one of the stolen items which I'm pretty sure is against any 7@RGE7 protocol. They sent the video in to the police. I got a phone call two days later from a detective telling us to come in with the things we stole but that it didnt matter if we did or didnt bring the items. We have stolen from them in several visits with the total price of things being over 600 but under 700 dollars. Just today I was called and told that my fiance and I both had warrants out for our arrest for a Class A and two Class B misdemeanors. I thought about getting a lawyer but didnt want to spend that much money if all of this was just some BS of him just wanting us to come in and confess. Any help will be much appreciated.

    You say you're guilty. You were caught. You're on video. You can expect to be convicted if this goes to trial.

    I would say that if you dispose of the items, the burden of proof would fall on the store. This is why shoplifting is so hard to prove. Unless you guys were pretty darn obvious on the camera, you can still dispose of the items. They need to have proof throughout the entire time. They need to see you take the items, conceal them, have you monitored the entire (and I mean the entire time from that point) unless you have the items in plain visibility at another time and then the clock restarts. They need to see you not pay for the items. And then generally they need to obtain the items in your possession. In the case of items that can be marked, or somehow identified they can get them on you at a later time.
    Not saying that you should deny, just letting you know how hard it is to prove.
    What exactly do you mean by held up the trash from the items?

    Those are policies followed by most store loss prevention departments not state law. The "six steps" may have little to no bearing in court. Let alone concealment of merchandise is a crime in most states, if a subject is on camera doing that recovering merchandise will mean very little.
