Illinois: We are a private sector employer. Our employment application asks all the pertinent ADA questions, and asks about felony convictions. Our company policy won't allow hiring anyone with a felony conviction. Currently, the applicants complete the application before the interview and we have a chance to review it. If they check the box 'yes', we tell them of the policy at that time. We don't continue with the interview, however we have now wasted their time (and ours).
We want to change our process by conducting formal phone interviews as a first step. We will provide the applicants with a verbal statement of information about our company, including the policy about felony convictions, and background checks. That way, it may deter those who are ineligible without wasting their time.
Can we do this?
