    Default First Offense Marijuana Possession

    My question involves criminal law for the state of: Indiana

    Last week I was pulled over and ticketed for possession of marijuana, possession of paraphernalia, and underage possession of alcohol.
    For some reason, the state cop didn't take me into jail...he just let me leave with a ticket.

    I asked a friend and he told me to plead NOT guilty to everything, but I thought the best thing was to tell the truth? Especially considering I had already told the cop that I had drank the night before, I had smoked earlier that day, and that all of that stuff was mine AND he had confiscated everything from me.
    I am assuming that lying may just get me into more trouble but i've never had to deal with anything like this.

    I am 18 years old and I live with my grandparents. Is it going to be possible at all for me to hide all of this or am I going to have to tell them? They think that I am a really good kid.
    The only times I have ever got in trouble before were for a few (i think 3) traffic tickets, the last one in which I deferred.

    Please help and give me as much information as possible. I am an over-analytical guy and a lot has been going through my head.

    Your friend is right. Plead Not Guilty and ask for a Public Defender (I am assuming you cannot afford private counsel.)

    If you plead Guilty, you tie the court's hands and have no chance for a reduced sentence. If you plead Not Guilty, your attorney can negotiate on your behalf.

    Is it going to be possible at all for me to hide all of this or am I going to have to tell them? They think that I am a really good kid.
    Your arrest and the court proceedings are a matter of public record, so you're probably not going to have any success keeping this from them. And you ought not be lying to your grandparents, anyway. Come clean with them.

    Consult a local lawyer about any "first offender" programs for which you may qualify, that might allow you to avoid a conviction.

    Pleading not guilty is not the same thing as lying. It's just saying that you want to make the state prove it's case.
