    Default Unpaid Wages and Overtime

    Two questions, in the states of Florida and Georgia

    Florida: A friend working at a retail/food service job has worked several hours of overtime the past few weeks. The general manager of the store, to save labor, reportedly has been editing the clock-in/out times of employees and many are noticing shortages in their paychecks. My friend has not been paid any of the overtime she worked.
    Where can she go or who can she talk to, to recover the wages she's owed, if the general manager or supervisors say there's nothing they can do about it?


    Georgia: My boyfriend was hired at a food service establishment last year. They had all his application and employment information enough to clock him in and have him work for them for three weeks, and then we moved away. When he called to ask about his paycheck, we found out that he was not issued one because his employment packet was supposedly not filled out (or papers were lost by the GM at the time). Is there a time limit to try and recover what he should have been paid? He decided early on it was too complicated to deal with from another state, but now he's regretting just giving up three weeks' wages to avoid paperwork. Also, where did the company go wrong legally (since it was obviously a mistake on the company's behalf)?

    The answer to both questions is simple:

    If you were in other states, I would recommend filing a claim with the state DOL. However, Florida does not have one and Georgia's is exceedingly weak. So both your friends should file in small claims court for their respective jurisdictions for the money they are owed.

    You can also file a claim with the federal DOL-Wage Hour Division.
