    Default Shoplifted, First Time, is it Possible to Get It Off My Record

    My question involves criminal law for the state of: Texas

    I was arrested For a class B misdemeanor (theft), my first ever offense and I am 18 years of age. Got released the next morning on a pretrial bond. Have not yet been to court.
    My question is is there a way for me to get this off my record? like through a diversion program. I am in the process of getting a NROTC Scholarship, and i do not want this first and last mistake to mitigate my chances of receiving it. I will know in a few weeks to a month whether i may receive it or not. I am hoping i can get this off my record somehow or get it delayed so they may not see it until after i have already been awarded the scholarship. is there anything i can do?

    scholarship is the last of your concerns....if you end up with a criminal record (which some 1st offenders do), you will have trouble finding employment or school for the REST of your life. That is if your state does not pardon convictions.

    If you get a deferral, you can eventually petition to have the record sealed. If you get it reduced to a Class C misdemeanor and get a deferral, you can petition to have the charge expunged after you successfully complete your sentence. I suggest consulting a local lawyer.

    thank you i guess...

    but is there a way i can get a "pretrial diversion, pretrial intervention, withheld adjudication, good behavior, withdraw and file, deferred prosecution, and withheld sentencing."

    how can i got about doing this?

    I would really hate for this to be on my record. Anybody know what i can do?

    okay, thank you, i recently was talking to a lawyer, they said they can get me through either a pretrial diversion program, or they can just have me do some community service and have it all dismissed. however they wanted 2000 dollars, could i go through this with out having to go through the lawyers? if so, please tell me how i may go about this. thank you

    Each state varies, some state will put you in such program without even you asking for it (handed down by the judge). In other states, you have to argue why you deserve this program...

    When is your next court date? If you haven't pleaded yet, then the next time you go in plead not guilty and ask for such program. If you are uncertain then I would go with the lawyer in this case, 2,000$ really is not much considering the life-long impact of a possible conviction in your case.

    You could try to obtain a public defender if you qualify. Or you can try to work the the DA yourself (not always a good idea).
