    Default Behind on Restitution

    My question involves criminal law for the state of: Florida

    I am currently on Felony Probation for 3rd Degree Grand Theft in the state of Florida. At the time of court over the matter, I was given a withold of adjudication, ordered to pay restitution and placed on probation for 5 years.

    During the last year or so before the economy collapsed I had been making payments of $500 a month as ordered by the court. And then I lost my job. I lost it because I was being promoted to management, I disclosed my criminal history and even after disclosing it, they pulled a background check as they said they would, and then fired me for it.

    I ended up not being able to pay restitution for several months, and taken into custody at a monthly probation reporting date. The judge extended my probation 2 years.

    However, now, in the business I'm in, I'm barely able to make ends meet, I haven't paid restitution in 2 months, and I don't know if I'm going to be able to make it this month either, AND I lost my job again in February (being the guy with a criminal record, even though I'm flying strait, my former boss who is a drug addict had been embezzling money to fuel his addiction, pointed the finger at me and fired me because I'd be an easy scapegoat), I ended up being out of work for the whole month and I managed to be rehired by a different location.

    I'm currently facing an eviction in the next month because I can't pay my rent, and finding a job with no formal post-secondary education in broward county is extremely difficult.

    Is there any possibility of getting this restitution transferred into a civil judgment or lien of some sort. I need to be able to take advantage of this withold of adjudication to get myself back on my feet. At the time of sentencing I was fully able to make my $500 minimum monthly payment, but the way the economy has tanked, and the slow season for business coming around the corner, I'm terrified about where this will take me.

    Yes, I know I made my mistake and have to pay for it, but if I'm doing everything I can to make it right, I don't want to be punished even more.

    Even worse, my girlfriend's aunt offered me a job in NY state, which would more than adequately provide me a sufficient salary to live and work. However, being behind about $2000 in restitution, my probation officer won't start the Interstate Compact process.

    I'm starting to feel like I'm running out of options, I can't even afford a lawyer to get counsel.

    If you want to try to work something out in relation to when or how you pay your restitution, you need to be talking to your probation officer.
