    Default Expungement Hearing in Illinois

    I have my expungement hearing tomorrow in Illinois. I was charged in November for retail theft, but I got into a deferred prosecution program and the charges were dismissed. Since I have already been denied a job for this, I needed to get this dismissal and arrest record expunged.

    I am going in representing myself and I have absolutely no idea what to expect or what I will be needing to say. I know it's a little late, but anyone's input will help!

    You were charges in November but you got into a deferred prosecution program and it was dismissed? Sorry theres something out of ordinary here. I currently reside in Illinois also and it goes like this either you are guilty of the Class A mis. or you probably got withheld sentence/court supervision which mean that after you pay everything off you have to wait 5 years after the mess (probation, supervision) to get this off your record. If you in fact got it dismissed you will go into the courtroom the judge will read your request off, ask the states attorney if they have any objections, if they dont then it will be granted and usually takes about 30-90 days to be completly processed. You will need to do some follow up work with the Illinois State Police and FBI yourself to make sure that the charge is not showing up to the general public. I've been through the process so this is how mine went quick, painless, and easy as long as all the guidelines are met.

    Sorry about that, you are correct. I am looking back through all my papers and it says that I was advised that no criminal charges will be filed in connection with this incident, so I guess I just have the arrest on my record saying I was arrested for retail theft. After some time from filing my paperwork at the circuit clerk, I did receive papers back from the state police saying that they have no objection to expunging my arrest as well. Thanks for your advice, I started reading up on the internet and it seemed as though I was going to need to speak, but your reassurance on the process helped.
