    Default My Car Broke Down Next to Fire Hydrant & I Just Got a Ticket. Can I Beat It in Court

    My question involves a traffic citation from the state of: New York City. My car just completely stopped running on ma and would not start back up so I was forced to push it to the closest open parking space which was about 6 ft. from a fire hydrant. Of course a couple hours later I got a ticket for parking within 10 ft of a fire hydrant. I'm also going to get a ticket tomorrow morning because I have alternate side of the street regulations on my block and of course I'm on the side where I have to move my car tomorrow. I'm going to leave a note for the traffic agent letting him/her know my car can't start but I'm sure they're still going to give me a ticket. I have a mechanic coming to fix the car tomorrow but can i beat these tickets in court somehow?

    you claim you were parked in a parking spot. If so, your defense would be you were in an authorized parking space but for some reason, I don;t think that is the case.

    Care to clarify?

    Sorry for the confusion. I just pulled out of a perfectly legal parking spot on my way to work. I drove about 15 ft before my car cut off on me. I was in the middle of the street and had to push it to the closest, nearest open space as to not cause any accidents. The only open space happened to be 5ft from a fire hydrant. I took a cab to work, came back & had a ticket for $115 waiting for me. I'm calling AA to come tow the car to a mechanic tomorrow. I'm wondering if I can prove (receipt from AA, receipt from mechanic, etc.) my car had to be towed and fixed in order for me to operate it, is that legitimate grounds to dismiss the fire hdyrant ticket?

    That, I don;t know but I doubt it. I would bet that a judge or magistrate will tell you that if the car was broke down and you were having it towed, you should have stayed with it until it was towed.

    so, how did you get the car from near the hydrant to near your house/apartment?
