    Default Claiming Social Security Back

    I am a resident Alien and have been working in the United States for the past 8 years on Work Permit(H1B Visa). In the middle, I also attended graduate school as a full time student on an F1 visa. My question is that if I lose my job and have to leave the country for good, can I claim my social security back? If yes how and what is the process of doing so. Thanks

    Why not. I think it is possible if you are leaving the country for good and dont plan to come back for work. Someone told me this long time back. I just wanted to confirm.

    Did you confirm it from some sources ?? How do you know?

    actually I believe you are correct noney but I do not remember the requirements, limitations or actions required to apply for such a refund of contributions.

    So you are saying there is NO possibility that in your lifetime that you will ever choose to live and work in the U.S.? Where's the evidence of that?

    It is next to impossible to prove that a law does not exist. No clue how to do that.

    However, if it was possible for ANYONE to get a refund of Social Security contributions for whatever reason (including the current plan of never working or living in the U.S again), many, many people would ask for refunds. Lots of U.S. citizens believe Social Security will be broke when they are 62, so why are they continuing to pay into a system if it were voluntary or if they could say they plan to leave the U.S. and never come back?

    Search away for this regulation for refunds and if you find it, I will be the first to say I was wrong.

    There are totalization agreements with several countries, that allow for combining U.S. Social Security credits with that country's retirement system so that the combination of credits can increase the retirement benefits. Very complicated stuff. If non-residents could get refunds, why would this system even exist? I googled Totalization and Social Security and got 36,000+ hits.

    Another suggestion: Work 2 more years in the U.S. and you may have the 40 quarters you need to receive a small check at age 62, if Social Security is not broke.

    You will be subject to alien tax withholding though, at age 62. Under current law.
