My question involves collection proceedings in the State of Virginia. I have been mailed a copy of a warrant in debt against me for a medical bill that I have neglected to pay. The court date is set for the 31st of this month. I have not yet recieved a copy of this warrant at my home, being delivered by a sherriff. Is it leagal to just mail a copy of the warrant without having one delivered to me in person or posted on my door?
Also, I currently have a garnishment on me at this time. Is it possible for the court to award another garnishment to my paycheck. I am having a hard time making ends meet with my husband being on unemployment and making way less than we are used too. I can not afford being garnished twice from my pay. Is there anything that I can do since I am running out of time?
When I was served before I was served by mail and in person, I thought this is how it is suposed to be, can I use this in my defense and maybe have the court date postphoned?
