My question involves child support in the State of: Florida
My husband has received a pertition from Department of Revenue seeking child support from a previous girlfriend for her son and medical insurance. She was denied in 1993 because she refused a DNA test to establish paternity. My husband continued to share sporadic visitation with the other suspected father. My husband had given her money sporadically, as well. For the last 2 1/2 years we have consistently sent her money every month. He has failed the 8th grade 2x for inconsistent attendance. Last year his mother withdrew him from school and he worked full time until he was laid off and is now 16 going to be 17 in august and is reenrolled in an online schooling program that started in february of 2009. He is about to fail out of that, as well, for not doing his work and attending regularly.
Can we have him declared emancipated so as not to pay child support any longer?
