    Default Changes to Company Structure and Labor Certification

    Suppose that the company sponsors an H1B employee to get green card, but the company changes its entity type; for example, the company changes its entity type from LLC to C-Corporation. How is it going to affect his/her green card application process? Does it affect at all or there is nothing for him to be concerned about?

    Default Labor Certification

    It shouldn't be a problem as long as the company maintains its labor certification. If it becomes an entirely separate entity, particularly if it has a new EIN, it may also be necessary to transfer the H1-B visa to the new entity.
